Buying Antiques Online - here’s how it works:
  1. Review our purchase agreement.
  2. Search for a desired item using our search options or browse our antiques through categories listed to the left.
  3. When you find something you’d like to purchase or learn more about, call us (415.407.2153) or email us with the inventory number of the item.
  4. Our site allows for close inspection of each antique piece with 5 individual photos that can be magnified with an image zoom tool. We make a special effort to show imperfections, signature stamps and underneath the piece.We are happy to send more photos of any item you request and answer any questions you might have regarding the piece and its condition.
  5. Agree on a purchase price and pay for the item. All sales are final.
  6. Provide shipping information—shipping and delivery is not included in the price.

Sample Purchase Agreement

These Terms of Purchase are hereby entered into between you (“Buyer”) and Urban Chateau, LLC (“Urban Chateau”) and describe the terms and conditions applicable to the above referenced transaction to purchase the Subject Inventory Item(s) described above through the Urban Chateau Web Site (including the subsequent delivery of same). This is a legal and binding agreement. By signing and returning an executed copy of these Terms of Purchase to Urban Chateau, you acknowledge that you are authorized to enter into these Terms of Purchase and that you agree to the terms herein. If you do not agree to these Terms of Purchase, then do not return an executed copy of these Terms of Purchase to Urban Chateau and do not progress with completing the purchase of any Inventory Items. No change, addition or modification to these Terms of Purchase shall be binding upon Urban Chateau unless Urban Chateau consents thereto in writing.

1. Purchase Of Subject Inventory Items. These Terms of Purchase have been prepared in response to your purchase inquiry for the referenced Subject Inventory Items on the Urban Chateau Web Site. The Urban Chateau Web Site is designed for experienced buyers accustomed to buying antiques and period pieces (“Inventory Items”) based on photographs. Buyer is aware that Inventory Items shown on the Urban Chateau Web Site are not new, unless otherwise stated, or in perfect condition, and may require repairs or restoration prior to use. Available information about Inventory Items may be limited. All Inventory Items displayed on the Urban Chateau Web Site are offered for sale strictly subject to availability. If a Subject Inventory Item is for any reason not available upon Urban Chateau’s receipt of this Agreement and Buyer’s payment, Urban Chateau shall forthwith notify Buyer and return Buyer’s payment to Buyer and this Agreement shall terminate with respect to such Subject Inventory Item without further liability of the parties.

2. Accepted Orders. Buyer has placed an order from Urban Chateau through e-mail, telephone or facsimile inquiry with a description of the Subject Inventory Item. Urban Chateau has determined that the Subject Inventory Item is available and has completed, executed and submitted to Buyer these Terms of Purchase. Buyer acknowledges and agrees that upon executing and returning to Urban Chateau a copy of these Terms of Purchase and the applicable payment, Buyer enters into an irrevocable, binding contract to complete the purchase transaction of the described Subject Inventory Item(s) at the Purchase Price(s) set forth above. The Purchase Price includes the price of the Subject Inventory Item. Until Buyer returns the completed, executed Terms of Purchase, and the applicable payment to Urban Chateau, Buyer’s order is not considered placed, and Urban Chateau may sell the Subject Inventory Item to another purchaser or remove such item(s) from sale. The completed, executed Terms of Purchase must be returned to Urban Chateau by facsimile at (415) 407-2153, and the Purchase Price must be paid by wire transfer or by credit card (Visa, MasterCard, Discover or American Express) pursuant to the terms of Section 3, below.

3. Manner of Payment. All payments due from Buyer to Urban Chateau are payable in U.S. dollars. Unless Urban Chateau specifically approves another payment method, Buyer shall pay the Purchase Price to Urban Chateau by credit card or wire transfer.

By completing the credit card information and executing and returning these Terms of Purchase to Urban Chateau, Buyer hereby authorizes Urban Chateau to process the credit card transaction in the amount set forth above. If for any reason Buyer cancels a payment made by credit card or any other means without first receiving written approval from Urban Chateau, Buyer shall be liable for the full purchase price.

4. Title and Risk of Loss. Title to, and risk of loss, damage or destruction of, all Inventory Items ordered by Buyer passes to Buyer upon purchase.

5. Shipping. Shipping is the resposibility of the Buyer.

6. Taxes. Buyer is responsible for paying all local or state sales and use taxes related to the purchase of an Inventory Item (collectively, “Taxes”). If Urban Chateau is obligated to collect such taxes, Buyer shall pay Taxes to Urban Chateau in addition to the Purchase Price. Urban Chateau makes representation to Buyer regarding Buyer’s obligation to pay Taxes directly to local or state taxing authorities. Failure of Urban Chateau to collect such Taxes will not relieve Buyer’s obligation.

7. Import/Export Restrictions. Some of the Inventory Items sold on the Urban Chateau Web Site may require cultural, customs and endangered species permits for export from the country where they are located and/or import into Buyer’s country. Items may also be subject to a right of the country from which they are exported to purchase the Inventory Items from Urban Chateau, sometimes called a “right of preemption”. Urban Chateau does not make any representation or warranty, and shall not have any liability to Buyer in respect of, the requirement for, or the availability, or issuance of valid export or import permits or the existence or exercise of preemption rights to purchase by governmental or regulatory authorities anywhere. If a Subject Inventory Item is purchased by a third party pursuant to a preemption right or is otherwise unavailable, Urban Chateau shall forthwith notify Buyer and return Buyer’s full payment to Buyer and this Agreement shall terminate with respect to such Subject Inventory Item without further liability of the parties.

8. AS-IS SALE; DISCLAIMER OF WARRANTIES. INVENTORY ITEMS AVAILABLE ON THE URBAN CHATEAU WEB SITE ARE PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS. EXCEPT AS EXPRESSLY SET FORTH ON URBAN CHATEAU WEB SITE, URBAN CHATEAU MAKES NO GUARANTEE, WARRANTY OR REPRESENTATION, EXPRESSED OR IMPLIED, TO ANY BUYER WITH RESPECT TO ANY INVENTORY ITEM, INCLUDING WITHOUT LIMITATION, (A) ANY REPRESENTATION OR WARRANTY THAT AN INVENTORY ITEM MEETS BUYER’S REQUIREMENTS; (B) ANY REPRESENTATION OR WARRANTY WITH RESPECT TO TITLE TO AN INVENTORY ITEM; (C) ANY REPRESENTATION OR WARRANTY WITH RESPECT TO AN INVENTORY ITEM’S CONDITION, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUALITY, RARITY, IMPORTANCE, PROVENANCE, DESIGNER OR CREATOR, EXHIBITIONS, LITERATURE, HISTORICAL RELEVANCE OR OTHERWISE; OR (D) ANY REPRESENTATION OR WARRANTY THAT AN INVENTORY ITEM CONFORMS TO ITS DESCRIPTION OR THE COLORS, TEXTURE AND DETAIL SHOWN ON BUYER’S COMPUTER MONITOR. NO STATEMENT IN ANY PLACE OTHER THAN A WRITTEN STATEMENT ON THE URBAN CHATEAU WEB SITE, WHETHER ORAL OR WRITTEN, SHALL BE DEEMED TO BE A GUARANTEE, WARRANTY OR REPRESENTATION BY URBAN CHATEAU.

9. RELEASE AND LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUYER RELEASES URBAN CHATEAU FROM ALL CLAIMS, DEMANDS, LIABILITIES, ACTIONS, LOSSES AND DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE AND CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS AND/OR REVENUE), RELATED TO OR ARISING OUT OF OR IN CONNECTION WITH THE URBAN CHATEAU WEB SITE OR ANY INVENTORY ITEM OFFERED FOR SALE OR SOLD THROUGH THE URBAN CHATEAU WEB SITE. IF BUYER IS A CALIFORNIA RESIDENT, BUYER WAIVES CALIFORNIA CIVIL CODE §1542, WHICH SAYS: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.”

10. Fraud. Buyer may not register or place any orders for any Inventory Items under a false name or use an invalid or unauthorized credit card or use the Urban Chateau Web Site in a fraudulent manner. If fraudulent conduct is identified, Urban Chateau reserves the right to deny Buyer access to the Urban Chateau Web Site, to terminate this Agreement, to reject or void any purchases, whether successful or not, and to report such conduct to law enforcement authorities.

151. Notices. Any notices shall be given at the addresses (or as otherwise directed to the other party in writing) by electronic mail, facsimile or personal delivery. Unless otherwise provided herein, all notices shall be deemed to have been duly given on the date of receipt by the recipient (or if delivery is refused, the date of such refusal).

16. Governing Law and Jurisdiction. These Terms of Purchase shall be construed and interpreted according to the laws of the State of California, without regard to its conflicts of law principles. Buyer and Urban Chateau agree to submit any dispute arising under these Terms of Purchase to the exclusive jurisdiction of the state courts of California in the City and County of San Francisco or in the federal courts of the Northern District of California. The U. N. Convention on Contracts for the International Sale of Goods shall not apply to the terms and conditions of these Terms of Purchase.

12. Force Majeure. Urban Chateau shall not be in default or otherwise liable for any delay in or failure of its performance under these Terms of Purchase where such delay or failure of its performance under these Terms of Purchase arises by reason of any Act of God, or any government or any governmental body, acts of war, the elements, strikes or labor disputes, or other cause beyond the control of Urban Chateau.

13. Miscellaneous. If any provision of these Terms of Purchase is deemed unlawful, void or for any reason unenforceable, such provision(s) will be deemed severable from the rest of these Terms of Purchase and will not affect the validity and enforceability of the rest of these Terms of Purchase. Failure of Urban Chateau to exercise any rights or remedies will not constitute a waiver of any rights or remedies available to Urban Chateau under these Terms of Purchase or at law.
